recover the purchase price of a used irrigation pump and
accessories from defendant-appellant, Delmar Keyse, a/k/a D.C.
Keyse. The case was tried to a jury in the lower court and a
verdict was rendered for Scott. Keyse perfected this appeal after
his motion for a new trial was denied below. The sole question on appeal is whether the trial court abused
its discretion in overruling Keyse's motion for a continuance
immediately before the trial of the action.
