In these consolidated appeals, Jarrett Carl Scott and Mathew S. Liero (appellants) appeal from orders of the Court of Common Pleas of Northampton County (common pleas) dismissing their statutory appeals from a one-year suspension of their operating privileges. At issue is whether the Department of Transportation, Bureau of Driver Licensing (Department) met its burden of proving that appellants convictions under the New Jersey driving while intoxicated (DWI) statute are substantially similar to convictions under the Pennsylvania driving under the influence (DUI) statute.
